Terms of Service

These Terms of Service ("Terms") govern your use of SetterAI, an AI-assisted Instagram messaging platform operated by Adrian Zielinski ("we", "us", "our"). By using our services, you agree to these Terms.

1. Service Description

SetterAI is a platform that:

  • Connects to your Instagram Business or Creator account through official Meta APIs
  • Processes incoming direct messages from your Instagram contacts
  • Generates AI-assisted response suggestions for your review
  • Manages follow-up message scheduling
  • Provides a dashboard for conversation management and analytics

2. Account Requirements

To use SetterAI, you must:

  • Be at least 18 years old
  • Have a valid Instagram Business or Creator account
  • Have a Facebook Page connected to your Instagram account
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

You are responsible for ensuring that your use of SetterAI complies with Instagram's Terms of Use and Meta's Platform Terms.

3. Instagram Integration

Authorization

By connecting your Instagram account, you authorize SetterAI to:

  • Receive and read incoming direct messages on your behalf
  • Send messages through your Instagram account as configured by you
  • Access basic profile information of your Instagram Business/Creator account

Your Responsibilities

You are solely responsible for:

  • The content of all messages sent through your Instagram account, whether AI-generated or manually composed
  • Compliance with Instagram's Community Guidelines and Terms of Use
  • Ensuring that your use of automated messaging complies with applicable laws and Meta's policies
  • Monitoring and reviewing AI-generated responses
  • Maintaining the ability to disable AI and respond manually at any time

Messaging Limitations

Our service operates within the official Instagram Messaging API limits:

  • Messages can only be sent within Instagram's permitted messaging windows
  • Rate limits as imposed by Meta apply to all messaging
  • We do not guarantee message delivery, as this depends on Instagram's infrastructure

4. AI-Assisted Messaging

How AI Works

SetterAI uses third-party AI models to generate message suggestions based on:

  • Your configured AI settings and prompts
  • Conversation history and context
  • Contact information and profile data

Human Oversight

  • You can review, edit, and approve AI-generated responses before sending
  • You can disable AI for any individual contact at any time
  • You can configure AI behavior through dashboard settings
  • You maintain full control over your messaging strategy

AI Limitations

  • AI-generated responses may not always be accurate, appropriate, or optimal
  • We do not guarantee specific outcomes from AI-assisted messaging
  • You are responsible for reviewing AI behavior and adjusting settings as needed
  • AI responses should not be relied upon for legal, medical, financial, or other professional advice

5. Subscription and Payment

Plans and Pricing

  • Subscription plans, pricing, and message limits are as displayed on our website
  • All prices are in PLN (Polish Zloty) unless otherwise stated
  • Plans are billed monthly or annually as selected

Payment Processing

  • Payments are processed securely through Stripe
  • You authorize recurring charges according to your selected plan
  • Failed payments may result in service suspension

Refunds

  • Subscriptions are non-refundable once the billing period has started
  • If you cancel, you retain access until the end of the current billing period
  • We may offer refunds at our discretion in exceptional circumstances

6. Acceptable Use

You agree NOT to use SetterAI to:

  • Send spam, unsolicited messages, or bulk promotional content in violation of applicable laws
  • Harass, threaten, or abuse any person
  • Impersonate another person or entity
  • Send messages containing illegal, harmful, or offensive content
  • Violate any applicable law, regulation, or third-party rights
  • Attempt to circumvent platform rate limits or messaging restrictions
  • Use the service for phishing, fraud, or deceptive practices
  • Scrape, harvest, or collect data beyond what is necessary for the service
  • Resell or redistribute access to the service without authorization
  • Attempt to reverse-engineer, decompile, or extract source code from our platform

Violation of these terms may result in immediate account termination without refund.

7. Intellectual Property

Our Property

The SetterAI platform, including its design, code, features, documentation, and branding, is our intellectual property. You may not copy, modify, distribute, or create derivative works without our written consent.

Your Content

You retain ownership of your AI settings, custom prompts, and any content you create within the platform. By using our service, you grant us a limited license to process this content solely to provide the service.

Feedback

Any feedback, suggestions, or improvements you provide may be used by us to improve the service without obligation to you.

8. Data and Privacy

Your use of SetterAI is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using our service, you consent to our data practices as described in the Privacy Policy.

9. Service Availability

  • We strive to maintain high availability but do not guarantee uninterrupted service
  • We may perform maintenance, updates, or modifications that temporarily affect availability
  • We are not liable for downtime caused by third-party services (Instagram, Meta, AI providers, hosting)
  • We reserve the right to modify, suspend, or discontinue features with reasonable notice

10. Limitation of Liability

To the maximum extent permitted by law:

  • SetterAI is provided "as is" and "as available"
  • We make no warranties regarding the accuracy of AI-generated content
  • We are not liable for any messages sent through your Instagram account
  • We are not liable for any actions taken by Instagram/Meta regarding your account
  • Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim
  • We are not liable for indirect, incidental, special, or consequential damages

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • Your use of the service
  • Messages sent through your Instagram account
  • Your violation of these Terms or any applicable law
  • Your violation of Meta's Platform Terms or Instagram's Terms of Use

12. Termination

By You

You may cancel your subscription and delete your account at any time through the dashboard Settings.

By Us

We may terminate or suspend your account immediately if you:

  • Violate these Terms of Service
  • Use the service for prohibited purposes
  • Fail to pay applicable fees
  • Engage in activity that may harm our service or other users

Effect of Termination

Upon termination:

  • Your access to the service will cease immediately
  • We will disconnect your Instagram integration
  • Your data will be handled according to our Privacy Policy
  • Provisions that should survive termination (liability, indemnification) remain in effect

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or dashboard notification at least 14 days before they take effect. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of Poland. Any disputes shall be resolved by the competent courts in Poland.
